Welcome to MedleyHype.

These Terms of Service (“Terms”) govern your access to and use of the MedleyHype website, medleyhype.com (the “Site”), and any products, services, features, content, or functionality made available through the Site (collectively, the “Services”).

Throughout these Terms, the terms “MedleyHype,” “we,” “us,” and “our” refer to MedleyHype. The terms “you” and “your” refer to any visitor, customer, or other person who accesses or uses the Site or Services.

By accessing the Site, browsing the Site, creating an account, placing an order, or otherwise using our Services, you agree to be bound by these Terms and by any policies referenced in them, including our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree with these Terms, you should not access or use the Site or Services.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to offer and sell our products to you.

1. ELIGIBILITY AND ONLINE STORE TERMS

By using our Site or purchasing products from us, you represent that you are at least the age of majority in your province, state, territory, or country of residence, or that you have obtained any legally required consent to use the Services.

You may not use our Site, Services, or products for any unlawful, fraudulent, abusive, or unauthorized purpose.

You agree not to violate any applicable local, provincial, state, federal, national, or international law or regulation while using our Services.

You must not knowingly introduce viruses, malware, malicious code, or other technology that could harm, disrupt, disable, or interfere with the Site, Services, Shopify platform, or other users.

We reserve the right to suspend or terminate access to the Services where we reasonably believe these Terms have been violated.

2. GENERAL CONDITIONS

We reserve the right to refuse, restrict, suspend, or discontinue the Services, or any part of them, where permitted by applicable law.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, scrape, or commercially use any portion of the Site or Services without our prior written permission, except where such restriction is prohibited by law.

The headings used in these Terms are provided for convenience only and do not affect the interpretation of these Terms.

Nothing in these Terms is intended to exclude, restrict, or waive any consumer right or statutory protection that cannot legally be excluded, restricted, or waived.

3. PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices, and other information displayed on the Site are accurate and current.

However, product images may appear differently depending on your device, display settings, lighting, manufacturing variations, or product updates.

Packaging, colours, product components, specifications, and other details may occasionally change without materially affecting the intended function of the product.

We reserve the right to correct errors, inaccuracies, or omissions in product information and to update product descriptions where necessary.

Products may be available in limited quantities and may be discontinued or modified at any time, subject to applicable law.

4. AIRLIFTER+ AND PRODUCT USE

AirLifter+ and any other MedleyHype products must be used only in accordance with the instructions, warnings, intended use, and other information supplied with the product or made available by MedleyHype.

You are responsible for reviewing and following all product instructions before use.

Information provided on the Site regarding breathing, sleep, exercise, wellness, recovery, comfort, or other health-related topics is provided for general informational purposes only. It is not intended to replace professional medical advice, diagnosis, or treatment.

Unless expressly stated otherwise and supported as required by applicable law, MedleyHype products are not represented as products intended to diagnose, treat, cure, or prevent any disease or medical condition.

Individual experiences and results may vary.

If you have a medical condition, experience persistent breathing difficulties, have concerns about whether a product is suitable for you, or are receiving medical treatment, you should seek advice from an appropriately qualified healthcare professional.

You should discontinue use and seek appropriate assistance if you experience an unexpected or concerning reaction while using a product.

Nothing on the Site should be interpreted as establishing a healthcare provider-patient relationship.

5. PRICES, CURRENCY, AND TAXES

Product prices are displayed on the Site in the currency applicable to your selected market or location where supported.

Prices may change at any time without prior notice. Any price change will not affect an order that has already been accepted by us, except where correction is permitted by applicable law because of an obvious pricing or technical error.

Shipping charges, applicable taxes, and other charges will be displayed during checkout when applicable.

For international orders, customs duties, import taxes, brokerage charges, or other government or carrier fees may apply.

Where these charges are not collected at checkout, they are generally the responsibility of the customer.

6. ORDERS AND ORDER ACCEPTANCE

Submitting an order through the Site constitutes an offer to purchase the products in your order.

Receipt of an order confirmation does not necessarily mean that we have accepted your order.

We reserve the right, subject to applicable law, to accept, reject, limit, or cancel an order for reasons including:

Product unavailability;
Incorrect product or pricing information;
Suspected fraud or unauthorized activity;
Payment authorization issues;
Shipping restrictions;
Suspected resale or commercial redistribution;
Technical errors;
Violation of these Terms; or
Other legitimate operational or legal reasons.

If we cancel an order after payment has been processed, we will issue any refund required to the original payment method.

We may also limit quantities purchased per customer, household, payment method, billing address, or shipping address where reasonably necessary.

7. BILLING AND ACCOUNT INFORMATION

You agree to provide complete, accurate, and current information when placing an order or creating an account.

This includes your:

Name;
Email address;
Billing information;
Shipping address;
Telephone number where requested; and
Payment information.

You are responsible for ensuring that the shipping address provided at checkout is correct.

If you discover an error after placing an order, you should contact us as soon as possible. We will make reasonable efforts to assist, but we cannot guarantee that changes can be made once an order has entered processing, fulfillment, or shipping.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account, except where prohibited by law.

8. PAYMENT

Payment is required at the time specified during checkout.

Payment transactions may be processed by Shopify Payments or other third-party payment providers available through our Site.

We do not directly control the policies, security measures, authorization decisions, or processing systems of independent payment providers.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.

9. SHIPPING AND DELIVERY

Orders are generally processed according to the timeframes described in our Shipping Policy.

Shipping methods, estimated delivery times, and availability may vary depending on destination, product availability, fulfillment location, and carrier services.

Delivery estimates are estimates only unless expressly stated otherwise.

Actual delivery times may be affected by circumstances outside our reasonable control, including:

Carrier delays;
Customs processing;
Weather;
Holidays;
Incorrect or incomplete addresses;
Government restrictions;
Transportation disruptions; and
Other unexpected events.

Where tracking is available, tracking information will generally be provided after dispatch.

10. RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, and exchanges are governed by our Refund Policy.

Eligible return requests must generally be initiated within 30 days after receiving the applicable item and must satisfy the eligibility requirements set out in the Refund Policy.

Certain items may not be eligible for return due to hygiene, safety, condition, final-sale status, or other lawful restrictions.

Do not return a product without first contacting MedleyHype and receiving return instructions.

Approved refunds will generally be issued to the original payment method in accordance with our Refund Policy.

Processing times imposed by banks, credit card companies, payment providers, or other financial institutions are outside our control.

Nothing in our Refund Policy or these Terms limits any mandatory consumer rights available to you under applicable law.

11. DAMAGED, DEFECTIVE, OR INCORRECT ORDERS

Please inspect your order after delivery.

If your product arrives damaged, defective, incomplete, or different from what you ordered, contact us as soon as reasonably possible.

To assist us in reviewing the issue, we may request information such as:

Your order number;
Photographs of the product;
Photographs of the packaging;
A description of the issue; and
Other information reasonably necessary to investigate the claim.

Where appropriate, we will provide a remedy consistent with our policies and applicable consumer protection law.

12. ACCURACY OF WEBSITE INFORMATION

Although we make reasonable efforts to maintain accurate information, the Site may occasionally contain typographical errors, inaccuracies, omissions, technical errors, outdated information, or incorrect pricing or availability information.

We reserve the right to correct such errors and update information at any time.

If an error materially affects an order you have already placed, we will take reasonable steps to contact you and provide an appropriate resolution as required by applicable law.

13. PROMOTIONS, DISCOUNT CODES, AND SPECIAL OFFERS

From time to time, MedleyHype may offer promotional codes, discounts, giveaways, bundles, limited-time promotions, or other special offers.

Unless otherwise stated:

Promotions cannot be combined;
Promotions have no cash value;
Promotional codes may be limited to one use per customer;
Promotions may exclude certain products;
Promotions may have geographic or eligibility restrictions; and
Promotions may expire or be modified in accordance with their stated terms.

We reserve the right to cancel or refuse the use of a promotional offer in cases of fraud, abuse, manipulation, or material error.

Any specific terms provided with a promotion will apply in addition to these Terms.

14. OPTIONAL AND THIRD-PARTY SERVICES

The Site may provide access to services, applications, integrations, payment systems, order-tracking services, social-media platforms, analytics tools, or other features provided by third parties.

We do not control all third-party services and cannot guarantee their continued availability, operation, security, or accuracy.

Your use of third-party services may be governed by separate terms and privacy policies established by those providers.

To the extent permitted by law, MedleyHype is not responsible for loss or damage caused solely by your independent use of third-party websites or services.

15. THIRD-PARTY LINKS

The Site may contain links to websites or resources operated by third parties.

A link does not necessarily mean that MedleyHype endorses, controls, or is affiliated with the third-party website or its content.

We are not responsible for the content, practices, security, availability, products, services, or privacy policies of independent third-party websites.

You should review the applicable terms and policies before using a third-party website or service.

16. REVIEWS, FEEDBACK, AND USER CONTENT

You may have the opportunity to submit product reviews, photographs, comments, feedback, suggestions, testimonials, or other content (“User Content”).

You are responsible for the User Content you submit.

You agree that your User Content will not:

Be false or intentionally misleading;
Infringe another person's intellectual property rights;
Violate privacy or publicity rights;
Contain unlawful, threatening, defamatory, abusive, obscene, or discriminatory material;
Contain malware, viruses, or malicious code;
Impersonate another person; or
Otherwise violate applicable law.

Where you voluntarily submit User Content for publication, you grant MedleyHype a non-exclusive, worldwide, royalty-free licence to reproduce, display, publish, adapt, and use that content for operating, promoting, and improving MedleyHype and its products, subject to applicable privacy and consumer protection laws.

We may moderate or remove User Content where reasonably necessary, including content that violates these Terms or applicable law.

We are not obligated to publish every review or submission.

We will not knowingly alter a genuine customer review in a way that materially changes the customer's expressed opinion.

17. INTELLECTUAL PROPERTY

Unless otherwise stated, the Site and its contents—including text, branding, graphics, logos, photographs, videos, product presentation, website design, software, and other materials—are owned by, licensed to, or lawfully used by MedleyHype and are protected by applicable intellectual property laws.

You may access and use the Site for personal, non-commercial shopping and informational purposes.

You may not reproduce, distribute, modify, republish, commercially exploit, create derivative works from, or otherwise use protected Site content without appropriate authorization.

Third-party trademarks, names, logos, or other intellectual property appearing on the Site remain the property of their respective owners.

To violate any applicable law or regulation;
To infringe our intellectual property rights or the rights of another person;

By using the Services, you acknowledge that your personal information will be handled as described in our Privacy Policy and as otherwise permitted or required by applicable law.

20. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Site and Services are provided on an “as available” basis.

We do not guarantee that the Site will always be uninterrupted, error-free, secure, or available at all times.

We may temporarily suspend or restrict access for maintenance, upgrades, security, technical issues, or circumstances outside our control.

Any warranties, conditions, representations, or guarantees that cannot lawfully be excluded under applicable consumer protection law remain unaffected.

Nothing in these Terms excludes any statutory warranty, guarantee, or other consumer protection that applies to you and cannot legally be waived.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MedleyHype and its owners, directors, officers, employees, affiliates, contractors, service providers, suppliers, licensors, and agents will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from or related to your use of the Site or Services, except where such liability cannot legally be excluded or limited.

This may include, where permitted by law, loss of profits, loss of revenue, loss of data, loss of opportunity, or similar indirect losses.

Where liability cannot lawfully be excluded but may be limited, our liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms limits or excludes liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, death or personal injury where such liability cannot legally be excluded, or any other liability that applicable law does not permit us to exclude.

Nothing in this section limits your mandatory rights under applicable consumer protection legislation.

22. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold MedleyHype harmless from third-party claims, losses, liabilities, damages, costs, and reasonable legal expenses arising directly from:

Your unlawful use of the Site or Services;
Your material breach of these Terms;
Your infringement of another person's rights; or
Your fraudulent or intentionally wrongful conduct.

This section does not require you to indemnify MedleyHype for losses caused by MedleyHype's own unlawful conduct, negligence where such exclusion is prohibited, or any liability that cannot legally be transferred to you.

23. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

24. WAIVER

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

Any waiver must be made in accordance with applicable law and applies only to the particular circumstances for which it is given.

25. TERMINATION

These Terms remain effective while you access or use the Services.

You may stop using the Site or Services at any time.

We may suspend or terminate your access where reasonably necessary, including where you materially violate these Terms, misuse the Services, engage in fraud, compromise security, or use the Services unlawfully.

Any rights or obligations that by their nature should survive termination—including payment obligations, intellectual property provisions, liability provisions, and dispute-related provisions—will continue to apply after termination.

26. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any additional terms expressly presented in connection with a particular product, promotion, or Service, constitute the agreement between you and MedleyHype regarding your use of the Services.

If there is a conflict between these Terms and mandatory applicable law, the applicable law will control.

If specific terms are provided for a particular promotion, product, or service and conflict with these general Terms, the specific terms will apply to that particular matter to the extent of the conflict.

27. GOVERNING LAW

These Terms and your use of the Services are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles, except where the mandatory consumer protection laws of your place of residence require otherwise.

Subject to any rights you may have under mandatory applicable law, disputes arising from or relating to these Terms or the Services will be subject to the jurisdiction of the courts located in Ontario, Canada.

Nothing in this section prevents a consumer from exercising rights available under mandatory consumer protection laws applicable to them.

28. INTERNATIONAL CUSTOMERS

Customers located outside Canada may be entitled to additional mandatory consumer rights under the laws of their jurisdiction.

Nothing in these Terms is intended to remove or restrict any right that cannot legally be excluded by contract.

International customers are responsible for complying with applicable local laws regarding the purchase, importation, possession, and use of products purchased through the Site.

Customs duties, import taxes, brokerage charges, and other fees may apply as described in our Shipping Policy.

29. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, products, business practices, legal requirements, or other operational needs.

When we make changes, we will publish the updated Terms on this page and revise the “Last Updated” date.

Changes will apply prospectively unless applicable law requires otherwise.

Your continued use of the Site after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by law.
